Reevaluating the presidential runoff rule: Does a provision promote the protection of human rights?

ABSTRACT: In recent years, an increasing number of democracies have adopted a runoff rule to elect their president. Some have argued, however, that the benefits of such a rule are dubious at best. In this article, I seek to counter this claim, as I posit that a runoff rule promotes the protection of human rights by reducing outcomes that are negatively associated with high government respect for human rights. Using ordered logistic regression and an analysis of predicted probabilities, I find that democratic presidential elections held using a runoff rule produce presidents that are less likely to be associated with lower government respect for human rights, and more likely to be associated with greater government respect for human rights. I conclude by suggesting that politicians should consider embracing a presidential runoff rule, as its adoption could be a relatively easy way to reduce repression.

The effect of copartisan justice ministers on human rights in presidential democracies.

Project description:A body of literature suggests that states with independent courts are more likely to protect human rights. A recent article challenges this notion by arguing that when both the president and his or her justice minister share the same party-i.e., they are copartisans-that state is less likely to protect human rights, as justice ministers may value their loyalty to the president over their duty to enforce court decisions. In this article, I estimate government respect for human rights accounting for both copartisan justice ministers and an independent judiciary. In the end, I find copartisan justice ministers to be negatively associated with high government respect for human rights, even after controlling for judicial independence. Many constitutions already seek to ensure an independent judiciary, but if copartisan justice ministers increase the likelihood that governments repress, then perhaps constitutional engineers should also consider options that would reduce the likelihood that both the president and his or her justice minister share the same party.

Human Rights Texts: Converting Human Rights Primary Source Documents into Data.

Project description:We introduce and make publicly available a large corpus of digitized primary source human rights documents which are published annually by monitoring agencies that include Amnesty International, Human Rights Watch, the Lawyers Committee for Human Rights, and the United States Department of State. In addition to the digitized text, we also make available and describe document-term matrices, which are datasets that systematically organize the word counts from each unique document by each unique term within the corpus of human rights documents. To contextualize the importance of this corpus, we describe the development of coding procedures in the human rights community and several existing categorical indicators that have been created by human coding of the human rights documents contained in the corpus. We then discuss how the new human rights corpus and the existing human rights datasets can be used with a variety of statistical analyses and machine learning algorithms to help scholars understand how human rights practices and reporting have evolved over time. We close with a discussion of our plans for dataset maintenance, updating, and availability.

Human rights' interdependence and indivisibility: a glance over the human rights to water and sanitation.

Project description:BackgroundIn 1948 the Universal Declaration of Human Rights was drawn up. The content of this document was further reflected two treaties, the Covenant on Civil and Political Rights, and the Covenant on Economic, Social and Cultural Rights. To try to maintain the interrelationship between the rights contained in each document, the idea that all rights are interdependent and indivisible was stressed. Based on this vision, this study aimed to explore the extent to which the violation of the human rights to water and sanitation interferes with the guarantee of other rights, addressing the principles of interdependence and indivisibility.MethodsFor that, 24 homeless, in the city of Belo Horizonte, Brazil, were interviewed. Individual and group interviews were carried out in addition to participant observation. The content analysis was used in order to analyze the data collected.ResultsThe research found that violation of the rights to water and sanitation promotes violation of other rights, such as health and education rights, strengthening the view of rights' interdependence and indivisibility.ConclusionIt is important to affirm that the protection of human rights must be consolidated at an operational and normative level, aligned to concepts of indivisibility and interdependence as it has been proposed for approximately seven decades.

Managing Uncertainty in Runoff Estimation with the U.S. Environmental Protection Agency National Stormwater Calculator.

Project description:The U.S. Environmental Protection Agency National Stormwater Calculator (NSWC) simplifies the task of estimating runoff through a straightforward simulation process based on the EPA Stormwater Management Model. The NSWC accesses localized climate and soil hydrology data, and options to experiment with low-impact development (LID) features for parcels up to 5 ha in size. We discuss how the NSWC treats the urban hydrologic cycle and focus on the estimation uncertainty in soil hydrology and its impact on runoff simulation by comparing field-measured soil hydrologic data from 12 cities to corresponding NSWC estimates in three case studies. The default NSWC hydraulic conductivity is 10.1 mm/h, which underestimates conductivity measurements for New Orleans, Louisiana (95 ± 27 mm/h) and overestimates that for Omaha, Nebraska (3.0 ± 1.0 mm/h). Across all cities, the NSWC prediction, on average, underestimated hydraulic conductivity by 10.5 mm/h compared to corresponding measured values. In evaluating how LID interact with soil hydrology and runoff response, we found direct hydrologic interaction with pre-existing soil shows high sensitivity in runoff prediction, whereas LID isolated from soils show less impact. Simulations with LID on higher permeability soils indicate that nearly all of pre-LID runoff is treated; while features interacting with less-permeable soils treat only 50%. We highlight the NSWC as a screening-level tool for site runoff dynamics and its suitability in stormwater management.

Factors affecting the protection of data rights in sports events: a configurational analysis.

Project description:The development of algorithms and the spread of digital infrastructure have contributed significantly to the productivity of the digital economy. Data has come to be known as the "oil of the digital economy". At the same time, data has begun to participate more deeply in the production activities of the global sports industry chain, and the international discussion on how to protect the rights of sports event data has been increasing. Based on the configurational theory and fuzzy-set qualitative comparative analysis, this study discusses the factors affecting the protection of sports event data rights. The study found three configuration paths for achieving high enterprise data protection effectiveness and two for achieving low enterprise data protection effectiveness. The results of this study provide theoretical support for governments to address the issue of sports event data rights. They will also facilitate the safe use of data in sports, promote the global sports industry and humanitarian action development, and contribute to international sustainable development.

Nationalism and human rights: A replication and extension.

Project description:A recent article has found nationalism to be negatively associated with government respect for several human rights. In this article, I replicate the original study's findings, I demonstrate that these findings are robust to an alternate model specification, and I then extend the analysis to additional human rights not examined by the original author. Ultimately, I find that in comparison to when the chief executive is not nationalist, when the chief executive is highly nationalist, that state is less likely to be associated with high government respect for six 'empowerment' rights (i.e. the freedoms of assembly and association, electoral self-determination, speech, foreign movement, religion, and worker's rights), and more likely to be associated with low government respect for these six empowerment rights. This study suggests that nationalism's influence on human rights is greater than previous thought.

Dataset on human rights awareness in Northwest Nigeria.

Project description:The data in this article investigated the extent of human rights awareness in the seven States comprising the Northwest geopolitical zone of Nigeria and its relationship with the characteristics of the population in the light of limited human rights claims in the region. The data was obtained from 780 respondents using stratified and systematic random sampling techniques using with the help of a structured questionnaire. It is aimed at ascertaining, among others, the extent to which the population in the region is aware of human rights and the meaning of the terms 'marginalisation' and 'discrimination', whether the population is aware of how to claim human rights and whether the population is comfortable approaching the courts for human rights claims. The questionnaire also sought information on the most utilised sources of information, formal and informal factors that influence a decision to litigate human rights violations, and the most common complaint mechanisms employed by the population concerning human rights violations. The responses were analysed using Qualtrics software, and the data was presented using statistical representations. The data shows an appreciable level of human rights understanding in the region.
